General Terms and Conditions
Article 1 – Definitions
-
Service provider: Tessa van Rossen, trading under the name Tessa, Sentirologie or other trade names as described in the Chamber of Commerce.
-
Counterparty: The natural or legal person (Consumer or Business Party) who enters into an Agreement for a Service.
-
Service: All activities performed by the Service Provider, including individual sessions, live events (offline training/workshops), and online programs.
Article 2 – Applicability These terms and conditions apply to every offer and every Agreement between the Service Provider and the Counterparty. By booking a session, purchasing a ticket, or subscribing to an online program, the Counterparty agrees to these terms and conditions.
Article 3 – Personal Responsibility and Health Participation in sessions, events, or programs is entirely at one's own risk. The Counterparty must be in good mental and physical health and is personally responsible for his/her well-being. The services are aimed at personal development and are expressly not a substitute for medical or psychiatric care. The Service Provider provides a best-efforts obligation, not an obligation of result.
Article 4 – Payment Payment shall be made immediately upon booking via the webshop or the booking system, unless otherwise agreed in writing. Access to sessions, events, or online programs will only be granted after payment has been successfully completed. In the event of late payment, the Service Provider is entitled to suspend the performance of the Service or to refuse access.
Article 5 – Cancellation and Right of Withdrawal
-
Individual Sessions: Cancellation or rescheduling must be made in writing no later than 48 hours before the start. In the event of cancellation within 48 hours or a no-show, the Counterparty is liable for the full rate.
-
Tickets for Events: Tickets are personalized. Purchases of tickets for live events are final; no refunds will be given. Transfer to another participant is possible up to 7 days before the event via info@tessavanrossen.nl.
-
Right of withdrawal: Consumers have a statutory cooling-off period of 14 days after the purchase of a Service remotely. This right expires as soon as the performance of the Service has commenced with consent (e.g. by logging into an online program or attending a session/event within this period).
Article 6 – Modification or Cancellation by Service Provider The Service Provider reserves the right to reschedule an event (location or time) or to cancel it in the event of unforeseen circumstances or insufficient registrations. In the event of cancellation by the Service Provider, the participant is entitled to a refund or participation in a replacement event.
Article 7 – Liability The Service Provider is not liable for indirect damage, consequential damage, or damage due to loss/theft during events. Total liability is limited to a maximum of the amount of the relevant Agreement. The Service Provider provides no guarantees regarding specific results; the Counterparty remains responsible for its own decisions and actions after a session or event.
Article 8 – Intellectual Property and Visual Material
-
All rights to provided materials (video, audio, readers, models) rest with the Service Provider. Use is exclusively for personal, non-commercial use. Disclosure or reproduction is prohibited.
-
During events, recordings (photos/videos) may be made for marketing purposes. By participating, the participant grants permission for the use of these images on websites and social media.
Article 9 – Confidentiality Both parties are obliged to maintain confidentiality regarding all confidential information they have obtained from each other in the context of the Agreement.
Article 10 – Applicable Law All legal relationships shall be governed exclusively by Dutch law. Disputes shall be submitted to the competent court in the region where the Service Provider is established.
